                 PROCEDURE FOR SUBMITTING CHARTER SCHOOL WAIVER REQUESTS

Minnesota statute permits the Commissioner of the Minnesota Department of Education to grant waivers for charter school board membership under certain conditions.
M.S. 124D.10 Subd. 4c reads, Licensed teachers employed at the school, including teachers providing instruction under a contract with a cooperative, must be a majority of the members of the board of directors before the school completes its third year of operation, unless the commissioner waives the requirement for a majority of licensed teachers on the board.
If the school board meets the technical requirements outlined below, the primary criteria for screening the waiver requests will be whether or not the charter school adequately demonstrated that the proposed waiver will improve the effectiveness of the school.Revised:  December 2005

 

 

PROCESS FOR SUBMITTING WAIVER REQUESTS TO THE COMMISSIONER

 

I.          District will submit a written request to the Minnesota Department of Education (MDE) which includes the specified criteria outlined below.

 

II.         MDE charter school staff must review the materials prior to submission to the commissioner to ensure that the application is complete and include their recommendation to the commissioner.

 

REQUIRED COMPONENTS OF BOARD WAIVER REQUESTS.  All board membership waiver requests must include the following components:

 

I.                    Citation of the statute from which the school district needs a waiver.

 

II.         Explanation and educational justification for the waiver request.  The district must provide an explanation of how the waiver would improve the effectiveness of the school.

 

III.       The time period requested for the waiver and a description of the board composition that requires a waiver. (May extend up to the end of the contract period.)

 

IV.       Explanation of the method and timeframe for evaluating and reporting the effectiveness of the waiver.

 

V.        Name, address, and phone number of school district contact person.

 

VI.              Copy of the official board resolution approving the waiver request and a copy of the board meeting’s approved minutes, which demonstrate that the content of the waiver request documents to be submitted to MDE was thoroughly reviewed.

 

VII.      Evidence of community and staff input regarding the waiver request and a copy of the written notification to the school’s sponsor.
